Prenuptial Agreements in Georgia

A marriage is essentially a contract. Prenuptial agreements are no different. A prenuptial agreement (Prenup) is a contract between two consenting adults which becomes active once a marriage takes place. Prenups help to settle issues that might arise in the case of a divorce. These issues relate to the separation of marital and premarital assets.

The benefit of a prenup is that before two people are married, they decide how the division of property works, including who has the right to buy, sell, use, or transfer property and assets. It can also detail how spousal support (alimony) might work; in other words, if and how much alimony could theoretically be awarded. A prenup can decide which spouse would receive alimony and how a modification to alimony would be handled.

What Prenups Can’t Do

C hild custody and child support decisions cannot be decided in a prenup agreement. A child support and custody agreement must include a judge’s decision of the child’s well-being and best interests at the time of a divorce. Thus, they cannot be decided beforehand.
